Sellers:

The seller requests J & D Auto Auction, Inc. to act as their agent to sell a vehicle with the following understanding and agreement ::

* The correct and complete information is given to the best of seller's knowledge

* The seller must maintain insurance on, bear the risk of loss and release and hold harmless J & D Auto Auction, Inc. and its officers, employees, agents and representatives from liability for damage to or loss of his vehicle from accident, fire, theft or other occurance not their wrongful act.

* All sales are final and a check will be issued only after buyer has purchased the vehicle.

Buyers:

J & D Auto Auction, Inc. acts solely as seller's agent and makes no expressed or implied warranty or guaranty whatsoever and assumes no liability to buyer. Further, that buyer agrees:

* They will not rely solely on information obtained from J & D Auto Auction, Inc., but rather inspect the vehicle before purchasing it "AS IS"

* They, as a successful bidder, shall pay a deposit to the clerk an and said payment constitutes a final sale and thereafter buyer assumes all risk of loss regarding the vehicle on which he should maintain insurance and further releases and holds harmless J & D Auto Auction, Inc., its officers, employees, agents and representatives from liability fro damage to or loss of the vehicle from accident, fire, theft or other occurrence not their intentional wrongful act.

* Deposit will be forfeited if balance is not paid within 24 hours of approval of sale

* SOLD AS IS -- NO WARRANTY

* Vehicle must be removed at time of purchase
